The Patent Trial and Appeal Board (PTAB) is an administrative body of the USPTO that, among other things, conducts trials on inter partes, post-grant, and covered business method patent reviews and derivation proceedings.

Introduced by the America Invents Act, inter partes review (IPR) and covered business method (CBM) proceedings took effect in September 2012. The interactive Sankey diagram presented below tracks all 3,782 IPR and CBM proceedings that have had a final disposition by July 2016.  

The diagram shows the different states of a proceeding and the rate at which petitions advance through these states up until final disposition. It combines terminations by settlement, dismissal, or request for adverse judgement that occur before or after a trial institution.

How to Use the Visual:

This is a Sankey diagram implemented using the open source Sankey library of D3 (D3 is a Javascript visualization package). Sankey diagrams represent transfers between nodes through flows, where the width of the flow represents quantity transferred between two nodes. In this case, nodes represent the various states of a PTAB proceeding and the flows provide counts of petitions.

Highlighting data:

Hovering over a flow provides the number of petitions passing through two nodes while hovering over a node gives a count of petitions at that state. 

Interaction:

You may move the nodes vertically to dynamically rescale the flows and fit them to a new layout. Feel free to experiment!
